Aisha Dahiru, also known as “Binani,” ran for governor of Adamawa State in an election on March 18. The Independent National Electoral Commission (INEC) invalidated her proclamation of victory and she has filed another lawsuit against them.
Binani ran for governor of Adamawa on the All Progressives Congress, APC, ticket.
According to NAN, Binani’s lawyer Michael Aondoaka, SAN, has filed a new case in a Federal High Court in Abuja before Justice Donatus Okorowo.
She filed an ex-parte motion in the Federal High Court of Justice with the case number FHC/ABJ/CS/935/2023 against the Independent National Electoral Commission (INEC), the People’s Democratic Party (PDP), and the PDP’s candidate for governor, Ahmadu Fintiri.
Binani has filed another petition for judicial review of the electoral umpire’s decision to overturn the REC for Adamawa State, Hudu Yunusa-Ari’s proclamation that she was the election’s winner.
On Monday, Aondoaka moved the motion on Binani’s behalf, arguing that, per Section 149 of the Electoral Act, 2022, the matter should be decided by the election petition tribunal.
He said that Binani would lose her right to appeal the INEC’s verdict within the 180 days allotted by Section 285(6) after she submitted her case with the tribunal on May 6.
The attorney told the judge that Binani had already filed a similar petition before Justice Inyang Ekwo, but that the sister court had told her to go to a tribunal instead because the case included an election.
Therefore, he requested that the INEC’s decision be reviewed.
He stated that a promise had been made to show the court that this claim was not frivolous and that they were willing to pay whatever the court saw appropriate if it ruled against them.
After hearing from Andoaka, the judge put off making a decision.
