The Supreme Court of Nigeria has rejected the application of the All Progressives Congress (APC) and its governorship candidate, Akanimo Udofia, for a review of the judgement that upheld the election of Governor Umo Eno of Akwa Ibom State.
The apex court dismissed the application, which sought to overturn its final verdict that concluded the legal dispute on January 18, 2024.
During the proceedings, a lawyer, O.U. Orji, initially presented the motion for review on behalf of APC and Udofia.
However, sensing the court’s stance, he later indicated that he was holding the brief for another lawyer and sought to withdraw the case.
Justice Uwani Musa Aba-Aji, leading a panel of seven justices, questioned the lawyer’s actions, emphasizing the need for legal professionals to act in accordance with the principles of justice independently.
Senior Advocate of Nigeria, Damian Dodo, intervened on behalf of Orji, apologizing to the court for the motion. Orji subsequently apologized and requested the withdrawal of the motion.
In a brief ruling, Justice Uwani Musa Aba-Aji dismissed the motion and cautioned lawyers against being used by desperate politicians.
The panel highlighted that the lower courts’ decisions had adequately addressed the issues raised in the case, affirming the validity of Governor Umo Eno’s election victory.
The tribunal and the Court of Appeal had previously ruled that the appellants failed to substantiate their claims that Governor Eno forged his West African Examination Council (WAEC) result and that he was a former convict.
The Supreme Court’s decision brings finality to the legal battle over the Akwa Ibom State governorship election, affirming Governor Umo Eno’s victory.
